The project

What do the published sources say about the project?

The project is not finished, so everything below describes a plan or a construction stage, not a completed building.

  • The hotel page places the project in the Paseo South Gulch neighborhood, minutes from downtown Nashville (Note 3).
  • The brand’s March 2025 release lists these features: a ground-floor restaurant and lobby bar, a rooftop pool with a rooftop garden restaurant and bar, an indoor and outdoor fitness center, a writer’s room and library, two ballrooms, about 10,000 square feet of meeting and event space on the second floor, and, for residents, a private residential pool with a dining room and a whiskey and billiards room (Note 1).
  • Later releases describe the residents’ amenities differently, for example a private rooftop pool, a chef’s kitchen and a conservatory lounge in July 2025 and a speakeasy, a billiards salon and a pet spa in October 2025 (Notes 2, 5). The offering documents, not the press releases, define what residents can use.
  • In July 2026 a trade report said Ten Five Hospitality would lead the food and beverage program (Note 6).
  • ESa is the architect and Post Company is the interior designer (Note 1).

Tennessee and Nashville rules

Which Tennessee and Metro Nashville rules apply when buying here?

The project is still being built (Notes 2, 6, 3), so a buyer now would be buying from the developer before the building exists. This section describes what the statute text says; it is not legal advice, and your attorney should say whether each rule applies to your contract.

  • The Tennessee Condominium Act of 2008. Title 66, Chapter 27 of the Tennessee Code holds the Act in Parts 2 through 5 (Note 8). Section 66-27-202 applies those parts to condominiums created in Tennessee after January 1, 2009 (Note 9). Whether and when this project’s condominium is created depends on its recorded declaration, which is not among the sources cited here.
  • Residential units. Part 5, which holds the information and deposit rules below, “applies only to units restricted to residential purposes, unless expressly made applicable by the declaration” (Note 10). The project combines a hotel and residences (Note 1), so ask your attorney which recorded document restricts each unit and whether Part 5 applies.
  • Information from the declarant. Section 66-27-502(b) says that when construction is not yet complete, a declarant must, on request and within ten business days, give a purchaser or the purchaser’s lender the section 66-27-503 information, to the extent applicable and available. Anything not available by then must be provided at least ten business days before closing (Note 11).
  • What that information includes. Among other items: the recorded declaration and bylaws (or substantially final forms if not recorded), the association’s rules, a budget or projected budget with a statement on reserves for repairs and replacements, the projected assessments, any debt secured by common elements, any lease affecting common elements or amenities, an insurance statement, pending suits, and whether the board is still under declarant control and when that ends (Note 12).
  • If the declarant does not deliver. Where the declarant controls the association, section 66-27-505(b) says a buyer who does not receive the information in time may rescind the contract on notice, or extend the closing date until ten business days after the information arrives and seek specific performance, with recovery of costs and reasonable attorney’s fees (Note 13). Ask your attorney how the notice and timing work for your contract.
  • Deposits. Under section 66-27-506, a buyer’s deposit up to the first 10 percent of the price must be held in escrow in Tennessee by a licensed title insurer or agent, an attorney, a licensed real estate broker or an independent bonded escrow company. The declarant may use those funds for construction costs before completion only if a surety bond or an irrevocable letter of credit or equivalent guarantee backs repayment to the buyer. Money above 10 percent received after construction starts may be used for construction costs if the contract allows it, but not for salaries, commissions, real estate licensee expenses or advertising (Note 14).
  • Taxes on each unit. Once any unit owner other than the declarant exists, each unit is a separate parcel, separately taxed and assessed, and no separate tax may be assessed against the common elements (Note 15).
  • Zoning and permits in Metro Nashville. Metro says to start a zoning search with the Planning Department’s Parcel Viewer and, for new construction, to look at zoning entries with a status of “Current” (Note 17). Metro Codes does not keep a list of all building permits; its ePermits system shows construction permits with sign-offs and inspection status, and a separate portal holds permit documents (Note 16).
  • Metro property tax. For 2025 the General Services District rate was $2.782 per $100 of assessed value and the Urban Services District combined rate was $2.814, which is the $2.782 plus a $0.032 add-on; residential property is assessed at 25% of appraised value (Notes 18, 19). Metro defines the Urban Services District as the old City of Nashville plus areas added since (Note 20). Rates are set each year, so ask the Trustee which district a parcel is in and what the current rate is. Statements are mailed in October and are due by the last day of February (Note 21).
