The building

What do the published sources say about the building?

The hotel is described as complete and the residences as open, so the figures below describe a built project. Several details differ between sources, and each difference is shown.

  • The residences’ website places 196 residences on the top 20 floors of a 34-story tower anchored by Conrad Nashville by Hilton (Note 1). The management company’s April 2022 release describes the same 196 condominiums on the top 20 floors (Note 7).
  • The June 2022 release describes Broadwest as a mixed-use project master developed by Propst Development, with office space, 196 condominiums and the Conrad hotel (Note 3).
  • The 2022 release lists the hotel’s terrace pool, meeting space, restaurant and whiskey bar (Note 3). The sources reviewed do not say which hotel features are open to residential owners, so ask for the association documents and any use agreement.
  • Cooper Carry is the architect, and its project page lists architecture and interior design services for the residences (Notes 4, 6). Champalimaud Design was named in 2019 as the hotel’s interior designer (Note 5).
  • Details differ by source and date: the hotel is 234 rooms in the 2022 completion release and 237 in the 2019 plan, the hotel base is 14 stories in the 2019 reports and 13 in Cooper Carry’s page, and the street number is 1616 on the residences’ site and 1600 in the 2019 announcement (Notes 3, 4, 5, 6, 1).

Published descriptions are marketing and planning material. The recorded declaration, plat and the association’s current documents define what each unit and the common areas are.

Tennessee and Nashville rules

Which Tennessee and Metro Nashville rules apply when buying here?

Hilton lists the residences as open and the residences’ site says “Open Now” (Notes 2, 1), and Cooper Carry’s page says all units sold before the building opened (Note 6). The seller may therefore be an owner, or the developer if any unit is still unsold. The association’s duty described below applies to a purchaser either way. This section describes what the statute text says; it is not legal advice, and your attorney should say whether each rule applies to your purchase.

  • The Tennessee Condominium Act of 2008. Title 66, Chapter 27 of the Tennessee Code holds the Act in Parts 2 through 5 (Note 8). Section 66-27-202 applies those parts to condominiums created in Tennessee after January 1, 2009 (Note 9). The tower was announced in 2019 and its hotel was completed in 2022 (Notes 4, 3); confirm in the recorded declaration how and when the condominium was created.
  • Residential units. Part 5, which holds the information rules below, “applies only to units restricted to residential purposes, unless expressly made applicable by the declaration” (Note 10). The tower combines a hotel and residences (Notes 1, 3), so ask your attorney how the recorded documents classify the residences.
  • Information from the association. Section 66-27-502(a) says the association, on request from a unit owner, a purchaser or a lender, must provide the section 66-27-503 information within ten business days of receiving the request, to the extent applicable. The owner must tell a purchaser or lender how to reach the association, and the association may charge a reasonable fee. The requesting party may rely on what is provided unless it has actual knowledge to the contrary, and the information may be delivered in writing or electronically (Note 11).
  • What that information includes. Among other items: the declaration, bylaws and rules; the latest balance sheet, income statement and approved budget, with a statement on reserves for repairs and replacements; minutes for the past 24 months; the current monthly assessment and any special assessment applicable to the unit; fees due on a transfer; any additional fees for using common elements or amenities; an insurance statement; unsatisfied judgments and pending suits; a description of any lease affecting the common elements or amenities; assessments more than 60 days past due; and whether the board is still under declarant control (Note 12).
  • If the association does not deliver. Section 66-27-505(a) provides a $250 fine after a first request, a $500 fine if the information is still not supplied within ten business days after a second request, and recovery of costs and reasonable attorney’s fees (Note 13). Ask your attorney how to make and date the request.
  • Taxes on each unit. Once any unit owner other than the declarant exists, each unit is a separate parcel, separately taxed and assessed, and no separate tax may be assessed against the common elements (Note 14).
  • Zoning and permits in Metro Nashville. Metro says to start a zoning search with the Planning Department’s Parcel Viewer (Note 16). Metro Codes does not keep a list of all building permits; its ePermits system covers construction, trade and short-term rental permits and shows sign-offs and inspection status, and a separate portal holds permit documents (Note 15).
  • Metro property tax. For 2025 the General Services District rate was $2.782 per $100 of assessed value and the Urban Services District combined rate was $2.814, which is the $2.782 plus a $0.032 add-on; residential property is assessed at 25% of appraised value (Notes 17, 18). Metro defines the Urban Services District as the old City of Nashville plus areas added since (Note 19). Rates are set each year, so ask the Trustee which district a parcel is in and what the current rate is. Statements are mailed in October and are due by the last day of February (Note 20).
