## What do the published sources say about the building?

The building is finished and open, so the figures below describe it as built. Several counts differ between sources, and each difference is shown.

- Four Seasons’ fact sheet places the hotel on floors 7 through 14 and the residences on floors 15 through 40 of a 40-story tower (Note 1).
- The 2019 development release describes a downtown site beside the Cumberland River and near the SoBro area and Broadway (Note 2).
- Four Seasons lists the hotel’s spa, rooftop pool, two restaurants, meeting space and fitness facilities (Note 1). The sources cited here do not say which of these are open to residential owners, so ask for the association documents and any use agreement.
- Unit counts differ by source: 144 residences (Four Seasons), 143 in the 2019 plan releases and 142 in a 2024 magazine article, which also describes studios that Four Seasons’ bedroom mix does not list (Notes 1, 2, 7). The hotel is 235 rooms and suites in Four Seasons’ sheet and 236 in the 2019 releases and AECOM’s announcement (Notes 1, 2, 3).

Published descriptions are marketing and planning material. The recorded declaration, plat and the association’s current documents define what each unit and the common areas are.

## Which Tennessee and Metro Nashville rules apply when buying here?

The building opened in November 2022 (Note 1), so a buyer now would normally be buying a resale from an owner. This section describes what the statute text says; it is not legal advice, and your attorney should say whether each rule applies to your purchase.

- **The Tennessee Condominium Act of 2008.** Title 66, Chapter 27 of the Tennessee Code holds the Act in Parts 2 through 5 (Note 9). Section 66-27-202 applies those parts to condominiums created in Tennessee after January 1, 2009 (Note 10). The building was announced in 2019 and opened in 2022 (Notes 4, 1); confirm in the recorded declaration how and when the condominium was created.
- **Residential units.** Part 5, which holds the information rules below, “applies only to units restricted to residential purposes, unless expressly made applicable by the declaration” (Note 11). The building combines a hotel and residences (Note 1), so ask your attorney how the recorded documents classify the residences.
- **Information from the association.** Section 66-27-502(a) says the association, on request from a unit owner, a purchaser or a lender, must provide the section 66-27-503 information within ten business days of receiving the request, to the extent applicable. The owner must tell a purchaser or lender how to reach the association, and the association may charge a reasonable fee. The requesting party may rely on what is provided unless it has actual knowledge to the contrary, and the information may be delivered in writing or electronically (Note 12).
- **What that information includes.** Among other items: the declaration, bylaws and rules; the latest balance sheet, income statement and approved budget, with a statement on reserves for repairs and replacements and whether a reserve study was done; minutes for the past 24 months; the current monthly assessment and any special assessment applicable to the unit; fees due on a transfer; any additional fees for using common elements or amenities; an insurance statement; unsatisfied judgments and pending suits; and whether the board is still under declarant control (Note 13).
- **If the association does not deliver.** Section 66-27-505(a) provides fixed fines, which increase after a second request, and recovery of costs and reasonable attorney’s fees when the required information is not provided in time (Note 14). Ask your attorney how to make and date the request.
- **Taxes on each unit.** Once any unit owner other than the declarant exists, each unit is a separate parcel, separately taxed and assessed, and no separate tax may be assessed against the common elements (Note 15).
- **Zoning and permits in Metro Nashville.** Metro says to start a zoning search with the Planning Department’s Parcel Viewer (Note 17). Metro Codes does not keep a list of all building permits; its ePermits system covers construction, trade and short-term rental permits and shows sign-offs and inspection status, and a separate portal holds permit documents (Note 16).
- **Metro property tax.** For 2025 the General Services District rate was \$2.782 per \$100 of assessed value and the Urban Services District combined rate was \$2.814, which is the \$2.782 plus a \$0.032 add-on; residential property is assessed at 25% of appraised value (Notes 18, 19). Metro defines the Urban Services District as the old City of Nashville plus areas added since (Note 20). Rates are set each year, so ask the Trustee which district a parcel is in and what the current rate is. Statements are mailed in October and are due by the last day of February (Note 21).

This page does not reproduce the full statutes or the Metro code. Your attorney should review the association documents and the contract before you sign.

## What should you check before buying in Four Seasons Private Residences Nashville?

| Check | Why it matters here | Source |
|------------------------------------------|--------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------|--------------------------|
| The association information package | Ask in writing for the section 66-27-503 items as early as you can. The association has ten business days after it receives the request and may charge a reasonable fee | Notes 12, 13 |
| Budget, reserves and special assessments | The package should include the approved budget with a statement on reserves and whether a reserve study was done, 24 months of minutes, and the current monthly and any special assessment on the unit | Note 13 |
| Transfer fees and amenity fees | The statute lists fees due on a transfer and any additional fees for using common elements or other amenities. Ask which hotel features, if any, residential owners may use and what they pay | Notes 13, 1 |
| Insurance, suits and delinquencies | Ask for the insurance statement, any unsatisfied judgments and pending suits against the association, and the total of assessments more than 60 days past due | Note 13 |
| Who controls the association now | The statute lists whether the board is still under declarant control. Ask whether control has passed to owners and when | Note 13 |
| The hotel and residential relationship | Ask who owns and operates the hotel, what the agreements say about shared services, costs and the brand’s term, and how a change would affect owners | ABODE |
| Unit count, type and size | Four Seasons lists 144 residences; other sources give 143 or 142, and one mentions studios. Confirm your unit’s type, size and measurement method in the recorded declaration, plat and floor plan | Notes 1, 2, 7 |
| Address and legal description | Four Seasons gives 100 Demonbreun Street and a secondary source gives 160 2nd Avenue South. Use the recorded legal description and the Assessor’s parcel record, not marketing addresses | Notes 1, 8, 22 |
| Permit and zoning record | Look up the parcel’s zoning in Metro Planning’s Parcel Viewer and the permit sign-offs and inspection status in ePermits. Metro Codes says it keeps no single list of all permits | Notes 17, 16 |
| Rental and use rules | Ask whether the declaration or association rules limit leasing or short-term rental. Metro’s ePermits system covers short-term rental permits, so ask Metro Codes what applies to the unit | Note 16 |
| Property tax | Ask the Trustee or Assessor which district the parcel is in. Tax is based on the Assessor’s appraisal at 25% for residential property, not on the price paid, and each unit is taxed separately | Notes 15, 18, 20, 21, 22 |
| Representation | Ask any brokerage, in writing, whom it represents in your transaction before you sign anything | ABODE |

## Four Seasons Private Residences Nashville real estate: frequently asked questions

What is Four Seasons Private Residences Nashville?

It is the condominium residence component of the Four Seasons Hotel and Private Residences Nashville, a 40-story tower at 100 Demonbreun Street in downtown Nashville, Tennessee. Four Seasons lists 144 residences on floors 15 through 40 (Note 1). The Congress Group and AECOM Capital developed it (Notes 3, 2).

Is Four Seasons Private Residences Nashville finished?

Yes. Four Seasons’ fact sheet gives November 2022 as the opening (Note 1), and a November 2022 report said the building was open to guests (Note 6). Because it has been open since 2022, a buyer would normally be buying a resale from an owner, not from the developer.

How many residences does Four Seasons Private Residences Nashville have?

Four Seasons lists 144, made up of 36 one-bedroom, 80 two-bedroom and 20 three-bedroom homes plus eight half-floor three-bedroom penthouses (Note 1). The 2019 plan releases said 143 (Notes 2, 5), and a 2024 magazine article said 142 and mentioned studios (Note 7). Confirm your unit in the recorded declaration.

What do I get from the association when buying a resale in Tennessee?

On request, the association must provide the information listed in section 66-27-503 within ten business days of receiving the request, to the extent applicable, and may charge a reasonable fee (Notes 12, 13). The list includes the budget and reserve statement, minutes, assessments and any fees due on transfer (Note 13). Ask your attorney whether Part 5 applies to the unit (Note 11).

Does the unit have its own property tax bill?

Tennessee law says that once any unit owner other than the declarant exists, each unit is a separate parcel that is separately taxed and assessed (Note 15). In Metro Nashville, residential property is assessed at 25% of appraised value (Note 18). Ask the Trustee for the parcel’s district and current rate.

Does ABODE International Realty sell units in Four Seasons Private Residences Nashville?

ABODE International Realty LLC is licensed in Tennessee (Real Estate Firm 263936), with offices in Murfreesboro and Knoxville. It is not affiliated with Four Seasons or the developer, and it does not claim to hold this project’s sales listings. Ask any brokerage for its representation disclosure before you sign.
